Protecting sexual offence victims’ private information in court through independent legal representation

Welcome to our survey addressing the protection of sexual offence victims’ private information in court through Independent Legal Representation (ILR).

This Australian-first study explores how the private information of sexual offence victim-survivors, including medical and counselling notes, prior sexual experiences, and digital communications (such as phone records), can be better protected in court through independent legal representation (ILR) – a lawyer for victims. ILR can protect victim-survivors in court by providing them with information, advice and representation prior to and during court.

We are seeking to understand how victim-survivors of sexual offences experience the criminal prosecution process and whether ILR can help them feel more protected and empowered. The findings will contribute to policy and practice recommendations, advocating for reforms that better protect victim-survivors’ private information in court.
